Are Ministers not allowed to Marry gay Couples in a state where gay marriage is not allowed?

I need to make sure for an essay. So, if a minister is willing to wed gay couple in a state where gay marriage is not allowed s/he can't because the state won't give them any of the benefits of marriage, right? And isn't that unconstitutional?Are Ministers not allowed to Marry gay Couples in a state where gay marriage is not allowed?
A minister can marry anyone that he wants anywhere (even in a state where it is not allowed), but it just won't be legal, meaning that they can have a ceremony, but they won't get the official ';marriage license';. To be officially married, you have to appy for a marrige license at the county recorder's office, and they have to ';issue'; you one that you have your minisiter sign the day of your wedding to say that they have done the proper ceremony. If you just go down to the City Hall, you can be married without a minister even.

Churches can do whatever they wish about this. The state will not recognize the marriage if it is not legal in the state.





It is not unconstitutional at all. And anything else is. The Establishment Clause makes it clear that the State cannot infringe on the Church and the Church cannot infringe on the State.

The Establishment Clause is also in the 1st Amendment. You really should just accept the interpretation of the people who've been trained to do it... Freedom of religion is an individual right, not a corporate one. The EC applies to the responsibility to keep the church and state separate in the US. Freedom of religion just means the state cannot punish us for worshipping where and how we choose.
If the state doesn't legally recognize same sex marriage, then nobody can legally marry the couple, no matter what words or said or what ceremony is performed. It wouldn't be legal.





What part of the constitution are you disputing, that would make it illegal to deny a same sex couple marriage?
What people do is simply having a ceremony to celebrate their union without the Holy Blessing or the Legal union. Nothing is wrong cause there is no marriage.





ADD: Your example is not good. What about religions that practises cannibalism, we should let people eat people because it's their religious right, no. Doesn't work that way.
You should interview different clergy persons; Catholic, Jewish, Pentecostal, Christian, etc.


And, then go to a Justice of the Peace at the Court House.





If this project is due by Monday, you'd be better off asking in the Religious Section.
If the minister feels there is nothing wrong in what's called a union between same sex couples. It's not a marriage just a commitment between two people.





And it would depend on the church they choose.
no same sex unions are against god and sinful so if any minister does this he is condemned to hell--just giving the religious rights opinion--i believe that 2 loving people should be allowed to wed
